Terms of Service

These terms govern use of WatchHire's interview-integrity monitoring and AI interview services. By creating an account or using the service, the customer agrees to them.

1. The service

WatchHire provides two products. Anti-Cheat monitors an online interview for technical signals associated with undisclosed assistance and produces a report. AI Interview conducts an automated first-round interview. A customer's account grants access only to the products included in their plan.

2. What the results actually mean

WatchHire produces signals, not verdicts. Every flag is a heuristic indication that a technical condition was observed. It is not proof that a candidate cheated, and the integrity score is a summary of those signals, not a judgement of a person.

Detection is not exhaustive and cannot be. Some methods of obtaining assistance leave no trace our software can see, and some legitimate software or hardware can trigger a flag. A clean report is not a guarantee that no assistance occurred, and a flagged report is not a determination of misconduct.

The customer is solely responsible for hiring decisions. The customer agrees not to reject, disqualify, or take adverse action against a candidate on the basis of a WatchHire report alone, without human review and, where appropriate, giving the candidate a fair opportunity to respond. WatchHire is a decision-support tool, never a decision-maker.

Where WatchHire processes candidate data, it does so on the customer's instruction and on their behalf. The customer is responsible for having a lawful basis to collect it.

4. Candidate consent and the right to decline

The monitoring companion asks the candidate for consent before it scans anything, and the candidate may decline. If they decline, the report will record that monitoring was not confirmed. The identity check is optional and may be skipped. The customer must not present WatchHire to candidates as mandatory in a way that misrepresents these choices.

We aim to keep the service available and monitor it continuously, but it is provided without a guaranteed uptime commitment unless one is agreed separately in writing. We may need to take the service down for maintenance, and will give notice where reasonably possible.

7. Fees

Fees, billing period and included products are those agreed in writing with the customer. Unless agreed otherwise, fees are payable in advance and are non-refundable for a period already begun. We may change pricing with reasonable notice, effective from the next billing period.

Monthly plans include a set number of interviews per billing month, stated on the pricing page. The allowance resets on the billing anniversary and unused interviews do not carry over. Once the allowance is used, further interviews draw on prepaid credits. Credits are bought separately, do not expire, and are only spent after the monthly allowance for that period is exhausted. Where a customer has neither allowance nor credits remaining, new interviews cannot be scheduled until credits are added or the plan is upgraded. An interview already under way is never interrupted for this reason.

8. Data

Handling of personal data is described in our Privacy Policy, which forms part of these terms. The customer's interview data belongs to the customer, and may be exported or deleted on request. Retention periods are set out in that policy.

9. Suspension and termination

Either party may terminate with reasonable notice. We may suspend an account immediately where there is non-payment, a breach of section 5, or use that risks harm to candidates or to the service. On termination we will, on request, delete the customer's data, subject to any retention the law requires.

10. Warranties and liability

The service is provided "as is". To the maximum extent permitted by law we exclude implied warranties, including any warranty that the service will detect all forms of interview misconduct — which, as set out in section 2, it expressly cannot.

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, or for loss of profit, revenue, or opportunity. Our total aggregate liability arising out of or in connection with these terms is limited to the fees paid by the customer in the twelve months preceding the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Changes to these terms

We may update these terms and will update the date at the top of this page. Where a change is material, we will notify account owners. Continued use after that constitutes acceptance.

12. Governing law

These terms are governed by the laws of India, and the courts at Visakhapatnam, Andhra Pradesh have exclusive jurisdiction.
